TERMS & CONDITIONS: SUBSCRIPTION, PAYMENT & CANCELLATION
1. Subscription Terms
Where you enter into a subscription contract with us, you must provide cleared funds at the beginning of the period for which you are paying.
If it is not possible to obtain full payment for the goods from you, regardless of your subscription choice, then we are obliged to refuse to process your order and/or suspend any further orders to you.
If you choose a Payment in Advance option, the discount will be applied at checkout
If you have a month-to-month subscription you can cancel after the third month
If you have a Quarterly payment option with us, you can cancel after the first quarter but you must give us 14 day’s written notice before then end of the first quarter. If you fail to do so, your subscription will roll over to the next quarter & you will be liable for the payment for that quarter.
If you have an Annual payment option with us, you can cancel after the first year but you must give us 14 day’s written notice before then end of the first year. If you fail to do so, your subscription will roll over to the next year & you will be liable for the payment for that year.
Martin & Cox – Living Gifts reserves the right to collect unpaid subscriptions through the appropriate legal channels & may use external debt collection agencies to do this on their behalf. This does not affect your statutory rights.
2. Payment Terms
We will invoice you for payment upon receipt of your order. We accept no liability if a delivery is delayed because you have not made the payment. If it is not possible to obtain full payment for the goods from you, then we can refuse to process your order and/or suspend any further orders to you. This does not affect any other rights we may have.
3. Cancellation Rights (Products)
Under the Consumer Contracts Regulations 2014 you have the legal right to cancel your order up to seven working days after the day on which you receive your goods with the exception of any made to order items and digital items (e.g.: e-Books and online courses) where the item has been downloaded.
You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty. However, you will need to notify us in writing or in any other durable medium if you wish to cancel your contract.
Once you have notified us that you are cancelling your contract, any payment made to us will be refunded as soon as possible by the same method as the original payment was made, and in any event within 30 days of cancellation.
4. Cancellation (Subscriptions)
If you have a month-to-month subscription and you request to cancel after the 3rd of the month, there will be a £10 cancellation fee.
For subscriptions with a twelve month commitment, you will be charged 50% of your remaining commitment at the time of cancellation and an admin fee of £15 plus full price for any free gifts you have received as part of the commitment.
